How to Terminate Casual Employees

How do I terminate a casual employee, is a question we are frequently asked. First we need to understand how a casual employee is defined.

Casual Employee Termination Notice

Generally, a Casual Employee is defined as:

someone who has no guaranteed hours of work
usually works irregular hours (but can work regular hours)
doesn’t get paid sick or annual leave
is paid a casual loading instead of receiving benefits such as sick or annual leave
can end employment without notice, unless notice is required by a registered agreement, award or employment contract
not entitled to redundancy pay, unless they have worked for the employer on a regular and systematic basis.

The employment of a casual employee may be terminated by either party without notice, unless notice is required by a registered agreement, award or employment contract.

Before you give your casual employee termination notice, consider managing his/her poor performance first.
